Privacy policy

We understand how important it is to protect your personal information. This policy sets out how Lendal Asset Finance collects, uses, stores and discloses personal information, in particular through this website. It applies in addition to, and does not limit, our obligations under the Privacy Act 2020 (the Privacy Act) and other applicable New Zealand law.

Who we are

References to we, us and our mean Lendal Mortgages Limited, trading as Lendal Asset Finance and acting through its financial advisers, Matt Carr and Ari Toufexis. Lendal Mortgages is a Registered New Zealand Financial Services Provider (FSPR 1000734) and a member of the New Zealand Financial Services Group (NZFSG).

Your authorisation

By providing us with personal information, engaging us to arrange finance for you, or using this website, you consent to the collection, use, storage and disclosure of your personal information in accordance with this policy.

What personal information we collect

Personal information is information that identifies, or is capable of identifying, you. Through this website we collect:

• the details you enter into our enquiry form: your name, business name, email address, phone number, what you are looking to finance, the approximate amount, your timeframe, and anything you choose to tell us in the message field;
• technical information about your visit, such as your IP address, browser type, device type, pages viewed and how you arrived at our site (see "Cookies and analytics" below).

If you go on to engage us to arrange finance, we will collect further information needed to prepare and support an application, which may include your business's financial position, trading history, asset details, and identity and credit information. We may collect this from you directly or, with your authorisation, from third parties such as your accountant, your bank, credit reporting agencies and lenders.

Why we collect it

We collect and use personal information to:

• respond to your enquiry and talk with you about your finance needs;
• assess your situation, prepare applications and arrange asset finance on your behalf;
• communicate with you during and after the process, including about products and services we think may interest you (you can opt out of marketing at any time by telling us);
• meet our legal and regulatory obligations, including under the Financial Markets Conduct Act 2013 and anti-money laundering legislation;
• operate, secure and improve this website; and
• any other purpose you authorise or that is permitted by the Privacy Act.

Who we share it with

We may disclose your personal information, where necessary for the purposes above, to:

• Lenders and product providers that you ask us to approach, and related parties such as guarantors, valuers, insurers and their agents. Each lender has its own privacy policy that applies to information we pass to them on your behalf;
• NZFSG and its related bodies corporate, as our aggregator and compliance partner;
• Service providers who help us run this website and our business. In particular, enquiry form submissions are protected by Cloudflare Turnstile and delivered to us using Cloudflare and ElasticEmail infrastructure, and our website is hosted on Cloudflare. These providers may process data on servers outside New Zealand; we only use providers who are subject to privacy obligations comparable to those under the Privacy Act;
• our professional advisers, and any party who acquires or proposes to acquire an interest in our business;
• anyone we are legally required or authorised to share information with, including regulators and law enforcement; and
• anyone else you authorise.

We do not sell your personal information.

Cookies and analytics

This website uses a small number of cookies and similar technologies. Some are strictly necessary (for example, Cloudflare Turnstile uses cookies to distinguish humans from automated traffic on our enquiry form). We may also use Google Analytics and Google Ads conversion tracking to understand how visitors use the site and to measure the effectiveness of our advertising. These tools set cookies and collect information such as your IP address, device and pages viewed. Google's use of this data is governed by Google's privacy policy; you can opt out of personalised advertising at Google Ads Settings or by using the Google Analytics opt-out add-on. You can also block or delete cookies through your browser settings, although parts of the site may not work as intended if you do.

How we store and protect it

We take reasonable steps to protect personal information from loss, misuse and unauthorised access, modification or disclosure. Enquiry form submissions are transmitted over encrypted connections and emailed to us; we may also retain a secure copy of each submission so that no enquiry is lost if an email fails to arrive. Information you provide as part of a finance application is stored in our secure client management systems. We keep personal information only for as long as it is needed for the purposes above or as required by law, after which it is securely deleted or de-identified.

Information about other people

If you give us personal information about anyone else (for example, a business partner or guarantor), you confirm that you have collected it in accordance with the Privacy Act, that they have authorised you to disclose it to us and for us to use it in accordance with this policy, and that they have been told of their rights to access and correct it.

Your rights

You have the right under the Privacy Act to ask for access to the personal information we hold about you and to ask us to correct it. To do so, contact us using the details below. We will generally rely on you to tell us if any of your details change. If you are not satisfied with how we have handled your personal information, you can also complain to the Office of the Privacy Commissioner at privacy.org.nz.

Changes to this policy

We may update this policy from time to time to reflect changes in the law or our business. The current version will always be published on this page, with the date it was last updated shown at the top.
