These terms govern your use of the Lendal Asset Finance website at lendalassetfinance.co.nz (the site). By using the site you agree to them. If you do not agree, please do not use the site.

Who we are

The site is operated by Lendal Mortgages Limited, trading as Lendal Asset Finance (we, us, our). We are a Registered New Zealand Financial Services Provider (FSPR 1000734) and a member of the New Zealand Financial Services Group (NZFSG). Our advisers Matt Carr (FSPR 1000445) and Ari Toufexis (FSPR 1007991) are financial advisers who arrange asset finance for businesses. Our disclosure statement sets out how we are paid, our duties to you and how to make a complaint.

Information on this site is general

The content on this site describes the asset finance services we offer and explains, in general terms, how different finance structures work. It is provided for information only and does not take into account your business's particular circumstances, objectives or financial position. Nothing on this site is personalised financial advice, a recommendation to enter into any finance arrangement, or an offer or approval of finance. Before acting on anything you read here, talk to us or seek your own professional advice, including from your accountant on any tax treatment.

Finance is subject to lender approval

We arrange finance; we do not lend. Any finance we help you apply for is provided by third-party lenders and is subject to their credit criteria, terms, conditions and fees. Indicative timeframes, deposit requirements and structures described on this site are examples of what may be possible and are not a guarantee of any outcome. In most cases we are paid a commission by the lender when your finance settles; if a fee ever applies to your situation we will tell you clearly and in advance.

Using the enquiry form

Submitting an enquiry does not create an adviser-client relationship or oblige either of us to proceed. You agree to provide accurate information and not to submit anything unlawful, misleading, abusive or automated. Personal information you submit is handled in accordance with our privacy policy. Our enquiry form is protected by Cloudflare Turnstile.

Accuracy and availability

We take care to keep the site accurate and up to date, but we do not warrant that it is complete, current or error-free, or that it will always be available or free of viruses or other harmful components. We may change or remove content, or suspend the site, at any time without notice.

Intellectual property

The content of this site, including text, layout, graphics and logos, is owned by or licensed to us and is protected by copyright and other intellectual property laws. You may view, download and print pages for your own personal or internal business use. Any other use requires our written permission. Lender logos displayed on the site are the property of their respective owners.

Third-party links and services

The site may link to third-party websites, including lenders and Lendal Mortgages. Those sites are not under our control and we are not responsible for their content or privacy practices. Links are provided for convenience and do not imply endorsement.

Limitation of liability

To the fullest extent permitted by law, we exclude all liability for any loss or damage (including indirect or consequential loss, and loss of profit, revenue or business) arising from your use of, or reliance on, this site or its content. Nothing in these terms limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply and cannot be excluded. Where you are acquiring services for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply.

Complaints

If you have a concern about our service, please tell us first so we can put it right. If we cannot resolve it, you can refer it to our independent dispute resolution scheme, details of which are in our disclosure statement. Our service is free to use for complaints.

Changes to these terms

We may update these terms from time to time by publishing a revised version on this page. Your continued use of the site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
